Consent to Telehealth

23andMe, Inc. (“23andMe”) customers have an opportunity to participate in telehealth services coordinated through 23andMe and its service providers, subsidiaries, and affiliates, including Lemonaid Health, Inc., which contracts with licensed healthcare providers (“Providers”) to provide Telehealth Services. If you choose to participate, you may obtain diagnosis, treatment, and other follow-up clinical care and patient education through online visits with Providers.

All capitalized terms not defined in this Consent to Telehealth have the respective meanings set forth in the Telehealth Terms of Service.

Please read all of the important information below, and only use the Telehealth Services if you’ve read the full information and subsequently made an informed decision that telehealth is right for you. 

WHEN THE DUTY OF CARE BEGINS

The duty of care begins after a Provider has determined that you are a good candidate for Telehealth Services. You understand that the duty of care does not begin at the point of you making a request for diagnosis or treatment, answering questions, making payment, or starting a telehealth visit, but at the point at which the Provider accepts the duty of care.

The duty of care does not extend to your wider health beyond the scope of the Telehealth Service offering for which you have requested to receive consultation, diagnosis and/or treatment, even if you have told the Provider information about your health as part of the intake questionnaire.

ANTICIPATED BENEFITS AND POSSIBLE RISKS OF TELEHEALTH

Telehealth provides a convenient, efficient and discreet way to receive medical care and prescription medications, without leaving your home.  For example, telehealth may enable you to interact with a healthcare provider via audio, video and/or asynchronous data communications, such as secure messaging, and share health information and photo images with a healthcare provider without being in the same location. 

There are possible risks associated with telehealth to be aware of. Telehealth is not for medical or psychiatric emergency purposes, and may be limited and/or require additional or alternative care. Medical care could be delayed; you won’t necessarily speak or message with a healthcare provider in real time and there may be technical difficulties.  As with any healthcare provider recommendations, including over-the-counter medicines, certain recommended treatments can cause serious side effects and adverse events that include severe allergic reaction, permanent disability, and death. By accepting this Consent to Telehealth, you acknowledge the following risks and benefits:

  • I understand that no specific results are guaranteed. 
  • I understand that I should never use telehealth in a medical or psychiatric emergency. In an emergency, I should dial 911 or go to an emergency department.
  • I understand that by using the service for a telehealth consultation, I won’t have an in-person consultation or in-person physical exam that might identify a medical condition requiring further investigation or immediate treatment.
  • I understand that by using telehealth I won’t necessarily speak or message with a Provider in real time.
  • I understand that the Provider has the right to refuse care if, in the Provider’s professional judgment, the Telehealth Services are not medically or ethically appropriate, and that I may need to seek medical care and/or in-person treatment from an alternative source.
  • I understand that I must check messages about my healthcare coordinated through my 23andMe account because this is the way that a Provider will communicate important information to me. This important information may help me weigh the benefits and risks of a recommended treatment plan against alternative options available to me.
  • I understand that the only content in the Telehealth Services that constitutes professional medical advice is the personalized messages sent to me directly by a Provider, or the personalized advice a healthcare provider offers verbally during a visit. 
  • I understand all medical reports resulting from the telehealth visit are part of my medical record.
  • I understand that receiving telehealth treatment from Providers does not replace my relationship with my existing healthcare providers.
  • I understand that the websites, applications, and information systems used in the Telehealth Services incorporate network and software security protocols to protect the privacy, security, and integrity of my health information and my Medical Record Information. While a wide range of administrative, physical, and technical safeguards are used to protect my health information and my Medical Record Information, the privacy and confidentiality of my telehealth visit or my Medical Record Information cannot be guaranteed.
  • I understand the delivery of healthcare services via telehealth is an evolving field and the use of telehealth or other technology in my medical care and treatment may include applications of tools not specifically stated in this consent.
  • I understand that a technical failure affecting the Telehealth Services may result in the loss of my information and/or interrupt my online visit. In addition to any disclaimers that I agreed to by accepting the Telehealth Terms of Service, I agree to hold harmless the Providers and their service providers for any loss of information or delay in care resulting from a technical failure.

I hereby give my informed consent to receive medical care and treatment from the Providers via telehealth.

IMPORTANCE OF ANSWERING ALL QUESTIONS FULLY AND TRUTHFULLY

By accepting this Consent to Telehealth, you acknowledge the following responsibilities:

  • I understand that Providers rely on information that I provide to decide whether or not telehealth services are safe and appropriate.
  • I understand that it is my responsibility to respond to all questions about my health and medical history fully, honestly and accurately, and update the Providers on any changes to my health, symptoms, treatments, and medications. 
  • I understand that not providing full or accurate information in order to receive treatment may result in harm to myself, including greater risk of the Providers prescribing treatments that may not be necessary, appropriate, or safe, and result in serious adverse events, permanent disability, and death.
  • I understand that the Providers will consider information I provide to be accurate, true and complete.

The federal Physician Payments Sunshine Act requires that detailed information about payment and other payments of values worth over ten dollars ($10) from manufacturers of drugs, medical devices, and biologics to physicians and teaching hospitals be made available to the public. In all states other than Kansas, New Jersey and Texas, Telehealth Services are provided by LMND Medical Group, Inc., registered in California; if you are in Kansas this service is provided by LMND Medical Group, A Professional Association, registered in Kansas; if you are in New Jersey this service is provided by LMND Medical Group Professional Corporation, registered in New Jersey; and, if you are in Texas this service is provided by LMND Medical Group, A Professional Association, registered in Texas (collectively, “LMND Medical Group” or the “Providers”). Lemonaid Health, Inc. contracts with LMND Medical Group to provide the Telehealth Services.  Certain Telehealth Services are also provided by LPRXOne, LLC DBA Lemonaid Pharmacy. LMND Medical Group is comprised of healthcare providers, which include doctors, nurse practitioners, and other staff members.
